Terms of Allocation & Service
Last reviewed
This website is operated by QE4 GROUP, SOCIEDAD LIMITADA, trading as Born Slippy. Throughout the site, the terms we, us, and our refer to QE4 GROUP, SOCIEDAD LIMITADA. By visiting our site, applying for membership, or reserving an allocation, you engage in our Service and agree to be bound by the following Terms of Allocation & Service, alongside our Privacy Policy. These terms are drafted in accordance with Spanish Law 34/2002 (LSSI-CE) and Royal Legislative Decree 1/2007, the Consolidated Text of the General Law for the Defence of Consumers and Users.
Section 1 — Private membership and allocation model
- Allocation model. Born Slippy operates an application-based allocation model. We reserve the right to approve, defer, or decline membership applications at our sole discretion to maintain production capacity standards.
- Capped production and serialisation. Allocations are strictly limited per seasonal batch, being 250 units per quarterly drop, capped at 1,000 total global units for the Aptus 1.0. Each item is individually serialised to a registered member.
- Anti-commercial reselling. Allocation slots and serialised garments are assigned strictly for individual use. Commercial flipping, unauthorised secondary-market markups, or third-party distribution is strictly prohibited. We reserve the right to revoke member access and cancel orders placed by unauthorised resellers.
Section 2 — Bespoke manufacturing and lead times
- Made-to-measure specifications. Every Aptus 1.0 suit is custom cut to individual physiological profile data provided by the member via our 29 point tailoring engine.
- Production horizon. Once custom measurements are verified and an allocation is confirmed, your garment is handcrafted in our specialty European workshops and dispatched within your allocated delivery window, typically four weeks from measurement sign-off.
- Measurement accuracy. Members are strictly responsible for providing accurate initial inputs. Minor fitting adjustments are handled under our Member Fit Guarantee, subject to concierge review.
Section 3 — Pricing, taxes and payment terms
- All allocation pricing is displayed in Euros and includes applicable Value Added Tax (IVA) unless expressly stated otherwise.
- Payment in full. The full price of the allocation is payable at the time of order. There is no deposit and no balance stage. Payment secures your workshop production slot and is what begins the pattern process once your measurements are received.
- Payments are processed securely by our payment provider. We archive electronic proofs of transaction as required by Spanish commercial regulations.
- Cancellation before production. Where measurements have not yet been submitted and no pattern work has begun, an allocation may be cancelled on request and refunded in full, and the allocation returns to the available pool. See Section 5 for what applies once production has commenced.
- We reserve the right to adjust allocation pricing for future releases without prior notice. Price changes will not affect confirmed, active allocations.
Section 4 — Delivery and customs
We offer global shipping on all bespoke orders. Because each wetsuit is individually manufactured to your exact measurements, please review our regional shipping and tax policies below.
| Destination | Shipping | Duties, taxes and VAT |
|---|---|---|
| European Union and United Kingdom | Included, Delivered Duty Paid | Fully covered by us |
| International and rest of world, including Australia | Invoiced when your suit is ready | Customer’s responsibility |
| Norway, Switzerland and Malta | Invoiced when your suit is ready | Customer’s responsibility |
European Union and United Kingdom
All orders delivered within the standard European Union and the United Kingdom are shipped Delivered Duty Paid (DDP). This means all import taxes, duties, and VAT are fully covered by us. The price you pay at checkout is the final price, ensuring a seamless delivery with no hidden customs fees upon arrival.
International and rest of world, including Australia
For all destinations outside of the EU and UK, shipping is invoiced separately once your suit is finished, at the courier rate applicable to your delivery address. The customer is solely responsible for paying that shipping charge, together with any local import duties, customs fees, taxes, and VAT required by their respective local border authorities upon delivery.
European exceptions
Please note that shipments to Norway, Switzerland, and Malta are not covered under our standard duty-paid programme. Customers in these locations are invoiced separately for shipping once their suit is finished, and are responsible for their own local import charges and taxes upon delivery.
Section 5 — Exclusion of right of withdrawal for custom goods
Custom goods statutory exemption. In accordance with Article 103(c) of Royal Legislative Decree 1/2007, approving the General Law for the Defence of Consumers and Users, because every suit is individually custom-tailored to your unique physiological profile and specifications, the statutory right of withdrawal or cancellation does not apply. Once pattern cutting and production commence, allocations are final and non-refundable for change of mind.
Fit guarantee. If your custom suit requires adjustment upon arrival due to a verified tailoring deviation, our Member Concierge coordinates alterations under our certified European repair and fit network.
Section 6 — Physiological data and privacy
Submission of physiological photos, measurements, and personal details through our platform is strictly governed by our Privacy Policy and GDPR frameworks. Biometric and anatomical inputs are processed exclusively for pattern generation and are deleted once tailoring verification is complete.
Section 7 — Intellectual property
All content, technical designs, 180° shoulder articulation patterns, 3D mapping concepts, trademarks including BORN SLIPPY, and digital assets on this site are the exclusive intellectual property of QE4 GROUP, SOCIEDAD LIMITADA. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the service or product design without express written consent.
Section 8 — Limitation of liability
The services and custom products are manufactured to high technical and craftsmanship standards. In no event shall QE4 GROUP, SOCIEDAD LIMITADA, its directors, employees, or partners be liable for indirect, incidental, or consequential damages resulting from improper use of equipment in extreme ocean conditions beyond intended design specifications. Nothing in these terms limits liability for fraud, gross negligence, or statutory consumer rights that cannot be waived under Spanish law.
Section 9 — Governing law, dispute resolution and jurisdiction
In compliance with EU regulations on consumer dispute resolution, you can access the list of accredited out-of-court dispute resolution bodies at consumer-redress.ec.europa.eu.
